SALES TERMS AND CONDITIONS
Validity of the Sales Agreement, Product and Price Information
The terms and conditions apply when purchasing goods from the online store “Unplugged Shop” (hereinafter referred to as the Online Store), owned by OÜ MQ Gradisent (registration code 11531640), located at Rõõmu 3, Luige alevik, Kiili vald.
The prices of the products sold in the Online Store are indicated next to the products. The price includes the cost of delivering the goods. All prices of the goods sold in the Online Store are in euros.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when placing the order.
Information about the goods is provided directly next to the goods in the Online Store.
Placing an Order
To order, you must add the products you want to your shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. The amount of the charge will then be displayed on the screen, which can be paid securely through the payment methods displayed.
NOTE: When paying by Estonian bank transfer, be sure to click on the “Back to merchant” button on the bank page.
Payments are processed by Maksekeskus AS. Payment is made outside the Online Shop in a secure environment – in the case of payment by bank link in the secure environment of the respective bank and in the case of payment by credit card in the secure environment of Payment Centre AS. The Seller does not have access to the customer’s bank and credit card details. The contract enters into force as from the date of receipt of the amount due in the current account of the Online Shop.
The owner of the online shop is the controller of the personal data and transfers the personal data necessary for the execution of payments to the authorised processor Maksekeskus AS.
In the event that the ordered goods cannot be delivered due to the expiry of the goods or for any other reason, the buyer shall be informed thereof as soon as possible and the money paid (including the costs of delivery of the goods) shall be refunded without delay, but not later than 14 days from the date of sending the notification.
Delivery
The buyer has the following options for receiving the goods:
- Parcel machines
- Regular mail
- Pick up in person.
The delivery costs are borne by the buyer, and the relevant price information is displayed next to the delivery method.
Domestic shipments generally reach the destination specified by the buyer within 5 working days from the entry into force of the sales agreement. Delivery outside Estonia takes place within 30 calendar days.
In exceptional cases, the right to deliver the goods within up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods must not be used in any other way than is necessary to ascertain the nature, characteristics, and functioning of the goods in the same way as it is allowed to test the goods in a physical store.
If the goods have been used for purposes other than necessary to ascertain the nature, characteristics, and functioning of the goods or show signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
To return the goods, a free-form application must be filled out and sent to the email address no later than 14 days after receiving the goods.
The costs of returning the goods are borne by the buyer, except in cases where the reason for the return is that the product to be returned does not correspond to the order (e.g., wrong or defective product).
The buyer must return the goods within 14 days of submitting the application or provide proof that they have handed over the goods to the carrier within the aforementioned period.
The Online Store will refund the buyer immediately upon receiving the returned goods, but no later than 14 days after receiving the withdrawal application, all fees received from the buyer under the contract.
The Online Store may refuse to make refunds until it has received the item that is the subject of the contract back or until the buyer has provided proof that they have sent the item back, whichever occurs first.
If the buyer has explicitly chosen a delivery method different from the cheapest standard delivery method offered by the Online Store, the Online Store is not obliged to refund the cost that exceeds the cost associated with the standard delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Online Store has been significantly lower than the market price of the goods due to an error.
Right to File a Complaint
The Online Store is responsible for the non-compliance or defect of the goods sold to the buyer, which existed at the time of delivery of the goods and which becomes apparent within two years from the delivery of the goods to the buyer. Within the first year from the delivery of the goods to the buyer, it is presumed that the defect existed at the time of delivery of the goods. The Online Store is obliged to refute this presumption.
The buyer has the right to contact the Online Store within two months of the occurrence of a defect by sending an email to .
The Online Store is not responsible for defects that have occurred after the delivery of the goods to the buyer.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all fees associated with the sales contract.
The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store forwards personal data to companies providing transport services to deliver the goods.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to receive them.
The buyer can unsubscribe from offers and newsletters sent to their email at any time by notifying us via email or following the instructions provided in the email containing the offers.
Dispute Resolution
If the buyer has complaints regarding the Online Store, they should be sent to the email address .
If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The terms of the procedure can be found and an application can be submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The examination of the buyer’s complaint in the committee is free of charge.
